1. Contractual partner

The Camper Imperium brand is represented by Ci Performance KlG. Further information on the commercial register entry or authorised representation can be found in the legal notice.

The contractual partner for services and production services is Ci Performance KlG. Unless otherwise agreed, these General Terms and Conditions apply to all business sectors.

 

2. Scope

Camper Imperium reserves the right to change the General Terms and Conditions (hereinafter referred to as “GTC”) and their appendices. Contents of the appendices to the GTC are part of the GTC. The version of the General Terms and Conditions valid at the time of the order, agreement or contract conclusion and their appendices, which cannot be changed unilaterally, are decisive. The General Terms and Conditions are aimed at natural customers based in Switzerland and apply to all orders placed (in particular via the online shop), services offered and other concluded contracts. Conditions on the part of the customer that conflict with or deviate from these GTC shall not apply, even if Camper Imperium does not separately object to customer conditions that deviate from these GTC.

All agreements between Camper Imperium and the customer must be made in writing (e.g. letter or email). The language available for the conclusion of the contract is exclusively German, even if translation aids are made available in other languages. The GTC and their appendices apply to all legal transactions, namely orders, bookings and provision of services, which are made via the websites of www.camperimperium.com, www.camperimperium.ch, www.campermanufaktur.ch, www.pandoraalarm.ch and their subdomains (e.g www.camperimperium.com/onlineshop/) online or via email or in person.

 

3. Governing Law

Amsteg (UR) is the place of jurisdiction for all disputes arising directly or indirectly from a contractual or contractual relationship. The legal relationship is subject to Swiss law. The Camper Imperium is also entitled to sue for its claims against third parties at their place of residence.

In the case of rental contracts that have been concluded, the statutory provisions on package travel contracts in accordance with SR 944.3 do not apply to the contractual relationship either directly or correspondingly. The renting party arranges its own trip and uses the vehicle on its own responsibility. The lease is limited to the agreed duration. The tacit extension of the tenancy for an indefinite period of time due to continued use in accordance with Article 266 Paragraph 2 OR is excluded.

 

4. Privacy

Data protection is a matter of trust. That is why we follow the European General Data Protection Regulation (hereinafter "GDPR"), which has established itself internationally as the benchmark for strong, effective data protection. The data protection declaration is an integral part of these terms and conditions. By accepting these terms and conditions, the customer also agrees to the data protection declaration. The customer agrees that Camper Imperium stores his personal data and uses it for processing and fulfilling the contractual relationship or for information purposes without separate consent.

 

5. Offer

The presentation of rental vehicles, accessories, extras, products and services on the website and in the Camper Imperium online shop does not constitute a legally binding offer. The offer is valid as long as it is visible on the website and/or stocks last. Price and assortment changes are possible at any time. The images shown on the website and all information about the products are for illustration purposes and are non-binding. The specific information from the rental contract, purchase contracts and any contracts for separate services are decisive. The Camper Imperium is free to reject orders and service questions in whole or in part without giving reasons. In this case, the customer will be informed and any payments already made will be refunded. Further claims due to delay in delivery and service provision, delivery failure or non-performance of a service are excluded.

All prices on our website are in Swiss francs (CHF) including the statutory value added tax (VAT) and other taxes, unless otherwise stated. The price on the website at the time of ordering in the online shop or booking the vehicle is decisive. Camper Imperium offers non-binding services on the basis of the project agreement or customer request. This is an indicative offer. Invoicing takes place after the service has been provided for the actual service provided, including any additional expenses. We reserve the right to make price adjustments as a result of changed market conditions, inflation or exchange rate adjustments at any time without prior notice.

Discounts cannot be accumulated. Discount coupons as part of a discount and special campaign expire according to the campaign period specified and communicated on the website and in the newsletter and can only be redeemed during this limited period.

 

7. Payment Methods and Terms

The following payment methods and payment service providers are generally available on the website: bank transfer, QR payment slip or Twint. In the shop you can also pay via Twint or cash. The customer can obtain further information on the payment methods from the bank group used in each case. We reserve the right to change the payment methods and service providers offered at any time.

Payments must be made in Swiss francs. Purchase in the online shop or the provision of a service on account is not intended. Camper Imperium reserves the right to deviate from this at its own discretion. In the event of a delay in payment, we are entitled to cancel the vehicle booking, refuse to hand over the vehicle provided or to refrain from sending the goods without the need for a separate deadline. If payment is not made by the due date, the customer is in default. In this case, Camper Imperium reserves the right to charge the customer a reminder fee in addition to the invoice amount. In addition to paying the invoice amount, the customer is also obliged to reimburse all costs incurred as a result of the delay in payment. The cancellation and withdrawal conditions of these General Terms and Conditions apply accordingly.

In accordance with legal requirements, invoices are created exclusively in electronic form and sent to the email address provided. If an invoice is sent in paper form, the customer shall bear the additional costs incurred (e.g. postage).

 

8. Information and Advice Provided

Camper Imperium always endeavors to keep the data published and communicated in the context of a consultation as well as information in the online shop, the website and up to date and correct.

Due to production/delivery bottlenecks and sales via other channels, delivery backlogs may occur. Therefore, all information on availability and delivery time in the online shop or offers are without guarantee and can change at any time.

Furthermore, Camper Imperium assumes no liability whatsoever for the correctness or topicality of the information and content provided by external manufacturers or by Camper Imperium, even if this has been carefully researched. This applies in particular to articles published in Camper Imperium Magazine that were written on the basis of our specialist knowledge, experience and our own assessments or information that was researched for the purpose of publication. The Camper Empire also advises its customers on products, gives tips for DIY builders and makes recommendations for customer projects. All advice is given to the best of our knowledge and belief, but this cannot be assumed by the customer and, above all, no liability is assumed.

 

9. Copyright and Proprietary Rights

The content of this website is protected by copyright, in particular content such as text, layout or images. Any reproduction, distribution or other use is prohibited and only permitted with the express written consent of Camper Imperium. Camper Imperium reserves the right to take legal action if this requirement is violated.

 

10. Special Agreements and Severability

Telephone information and promises are non-binding and require written confirmation. The invalidity of one or more provisions of these General Terms and Conditions does not affect the validity of all other provisions. They will be replaced by an effective provision that comes as close as possible to the intended economic purpose of the invalid or ineffective provision. These General Terms and Conditions also apply to future offers and contracts within the framework of the business relationship with the customer, even if they are not agreed again.

The hiring party arranges its own journey and uses the vehicle on its own responsibility. The rental contract is limited to the agreed duration. The tacit extension of the rental relationship for an indefinite period due to continued use pursuant to Art. 266 para. 2 CO is excluded.

Appendix 1 to the General Terms and Conditions: Online shop

As of October 2022

1. Scope

Camper Imperium reserves the right to amend the appendix to the General Terms and Conditions. The version of the General Terms and Conditions valid at the time of the order, agreement or contract conclusion and their appendices, which cannot be changed unilaterally, are decisive. Contents of the appendices to the GTC are part of the GTC.

 

2. Conclusion of contract

The images, descriptions and prices of products on the website www.camperimperium.com as well as old/subdomains are non-binding and can be changed at any time. They do not represent a contractual offer. By ordering a product in the online shop, by telephone or email, or by making a sales inquiry after consultation between Camper Imperium and the customer, the customer submits a binding offer to purchase. The prerequisite for a valid purchase contract is the complete and truthful completion of the order form provided in the online shop or the data communicated via other channels (email, Whatsapp, etc.) on the scope of the order and on the person as well as the acceptance of the present General Terms and Conditions and their appendices. The Camper Imperium confirms receipt of the order with an automatically generated order confirmation by e-mail, for example. This only shows the customer that the order has arrived and that the purchase contract has been concluded under the condition of delivery and the correct price. A purchase contract is concluded through the ordering process and acceptance by Camper Imperium.

 

3. Delivery & Shipping

The customer's delivery address must be in Switzerland and the Principality of Lichtenstein. Deliveries abroad require a separate agreement with Camper Imperium. The shipping conditions are generally only valid within Switzerland and the Principality of Lichtenstein. For deliveries abroad, the customer bears the taxes and duties incurred as well as the package fees and any other administrative expenses. Delivery costs depend on the quantity of products ordered. The delivery costs communicated in the online shop apply. The delivery costs are listed as an additional item in the shopping cart and on the invoice.

Products marked as “available” in the online shop are usually prepared for delivery within 1 to 2 working days from receipt of the order or are ready for collection at the collection address (Grund 77, 6474 Amsteg, Switzerland). Collections can also be made on weekends by arrangement.

If a product is not in stock or marked as "available" incorrectly, the customer will be informed by e-mail or telephone and a new provisional delivery date will be agreed. The Camper Imperium strives for a quick subsequent delivery and sends backorders without additional shipping costs. If Camper Imperium is unable to confirm a binding delivery date within 30 calendar days of receipt of the order (with the exception of customer-specific products or ready-made goods, see below), the customer has the right to withdraw from the purchase contract. If an item can no longer be procured or manufactured, Camper Imperium can withdraw from the contract and must reimburse the customer in full for payments already made for the product in question. There are no further claims against Camper Imperium.

If the customer is not on site at the time of delivery, the delivery service will leave a collection notice in the mailbox, unless otherwise agreed between the delivery service and the customer. The customer must collect the delivery from the designated post office. Any order that is not picked up within the specified deadlines cannot be kept or refunded. The customer bears sole responsibility for orders picked up late and any warranty rights are excluded. The customer assumes responsibility for the delivered products, even if they were not received directly by the customer. If additional shipping costs arise due to an incorrect delivery address or incorrect address data, these costs are borne entirely by the customer. Camper Imperium reserves the right to charge a processing fee of 15 %, but at least CHF 40, for the additional work involved in returning the order. Third-party or payment service provider fees incurred as part of the order will not be refunded.

Products that are not listed in the Camper Imperium online shop or that may require a procurement time of more than 30 calendar days are considered customer-specific products or ready-made goods. Delivery times and dates for this type of order are agreed in writing or orally between Camper Imperium and the customer.

4. Retention of title, notification of defects and transfer of risk

The goods delivered or handed over to the customer remain the property of Camper Imperium until the purchase price has been paid in full.

If products are delivered with obvious damage to the packaging or the contents, the customer must complain to the delivery service immediately, without prejudice to their rights due to defects, and refuse acceptance. The customer is obliged to have a damage confirmation message handed over to the delivery man. All transport damage must also be reported immediately to Camper Imperium.

It is also the customer's responsibility to check the ordered products immediately upon receipt. Camper Imperium must be notified of any defects or deviations from the order by email info@camperimperium.com on the day of delivery, otherwise the goods are deemed to have been approved and all warranty rights are excluded. Camper Imperium reserves the right to request proof of the defect.

The risk of accidental deterioration or loss of the ordered goods passes to the buyer as soon as the shipment has been handed over to the person carrying out the transport. If Camper Imperium assumes the transport costs as agreed in individual cases, this has no influence on the transfer of risk.

5. Right of Withdrawal and Withdrawal

A return or exchange of purchased items as well as changes or cancellations of confirmed orders are not intended, but possible at Camper Imperium's discretion and as a gesture of goodwill. In the event of a cancellation accepted by Camper Imperium, the goods must be sent back to Camper Imperium GmbH, Grund 77, 6474 Amsteg at the customer's expense. Payments made will be refunded within 14 days minus a processing fee of 15 %, but at least 40 CHF. If the goods lose value, the buyer is only responsible for this if this results from a use of the same that exceeds the examination of the properties, condition or function of the goods. In the case of originally packaged or sealed goods, damage to the packaging or opening of the seal is a loss of value.

6. Guarantee and Warranty Conditions

Camper Imperium manufactures goods itself or offers goods from other manufacturers. Camper Imperium has no influence on the durability and functionality of the products or the warranty of other manufacturers. Warranty claims against Camper Imperium for products from other manufacturers are therefore excluded. However, the manufacturer's warranty information applies, insofar as this is valid in Switzerland. In all other respects, the Swiss statutory warranty provisions pursuant to Art. 197 ff. OR apply, unless these are contractually excluded.

There is no warranty claim for damage caused by improper use, incompatible use or defects that can be attributed to external influences. This could be, for example, elemental and moisture damage, fall and impact damage, the effects of violence or damage caused by modifications. Expendable parts such as batteries, cables, lamps, auxiliary materials and lubricants, fuses, etc. are excluded from any warranty. In the event of a warranty claim, Camper Imperium may, at its own discretion, carry out a free repair, replace the goods or provide a full or partial credit for the sale price.

7. Liability and Disclaimer

Camper Imperium is only liable for warranty claims listed under Section 6. Any further liability is excluded, in particular liability for damage that has not occurred to the products themselves. Under no circumstances shall liability be assumed for slight negligence, indirect and indirect damage, consequential damage, loss of profit or unrealized savings. Liability is also excluded for damage resulting from delays in delivery, improper use of the product, the use of incompatible spare parts or accessories, neglected or improper maintenance and repairs or force majeure. Claims for damages due to impossibility of performance, breach of contract, culpa in contrahendo and tort are excluded both against us and against our vicarious agents, unless intentional or grossly negligent action is involved.

Camper Imperium has no influence on the durability and functionality of the products or the warranty of other manufacturers. Warranty claims against Camper Imperium for products from other manufacturers are therefore excluded. However, the manufacturer's warranty information applies, insofar as this is valid in Switzerland. In all other respects, the Swiss statutory warranty provisions pursuant to Art. 197 ff. OR apply, unless these are contractually excluded.

There is no warranty claim for damage caused by improper use, incompatible use or defects that can be attributed to external influences. Camper Imperium reserves the right to amend the appendix to the General Terms and Conditions. The version of the General Terms and Conditions valid at the time of the order, agreement or contract conclusion and their appendices, which cannot be changed unilaterally, are decisive. 2. Subject matter of the contract, offer documents and conclusion of the contract

The subject of the contract is the individual conversion, various work (all-encompassing projects) on and the handover of a vehicle according to the agreed requirements. The ordering of services or production services offered by us is understood as an invitation to the customer to submit an offer. The Camper Imperium is free to reject orders and service questions in whole or in part without giving reasons. A contract only comes about through an offer on our part and subsequent order placement by the customer. The conclusion of the contract takes place through mutual expressions of will, i.e. if there is agreement on what one would like to agree with one another. These declarations of intent do not have to be made expressly and certainly not in writing, but above all through implied behavior. If the customer provides his own vehicle for individual conversion, we will only make a binding offer after inspecting it. For the details of the respective scope of services (vehicle, conversion measures, equipment criteria, etc.), reference is made to the product description selected and specified in the guideline offer and additional documents (e.g. email). All offers are subject to price changes.

The offer expires if it is not accepted in writing (also by e-mail) within two weeks of receipt or if the customer fails to make a down payment. The content of written order confirmations is decisive unless the customer objects immediately. There is no right of withdrawal, Camper Imperium can grant this as a gesture of goodwill. Any deviation, addition or ancillary agreement must be in writing to be effective.

The Camper Imperium reserves the property rights and copyrights for illustrations, drawings, calculations, 3D models and other documents. This applies in particular to written documents that are marked as confidential. The express written consent of Camper Imperium is required before they are passed on to third parties.

3. Project implementation

The basic process of a project is divided into the following steps: Inquiry by the customer, advice from Camper Imperium, agreement on the project details (possibly procurement of basic vehicles), preparation of a non-binding offer by Camper Imperium, binding order by the customer, project implementation at the Camper Imperium business location, handover to the customer at the business location (unless otherwise agreed). The customer agrees that structurally necessary changes to the vehicle that are made for the expansion/conversion or the agreed service are considered contractually agreed. These are, for example, interventions in the existing electrical system, laying new cables, or changes to the body (cutting, drilling, etc.). The Camper Imperium declares that all work is carried out in accordance with the recognized rules of technology. If an approval of the technical change by the traffic office is required by law, this will be done by agreement with Camper Imperium. If the customer decides against the MFK service, any approval guarantee that may have been given expires.

Installations and conversions are made individually according to customer requirements to match the vehicle and cannot be used for other vehicles.

Change requests that are made after the start of the project and cause additional costs are to be borne by the customer.

 

4. Customer Prerequisites

The customer undertakes to make his vehicle available punctually on the date specified for the agreed project. If the vehicle is not handed over at the agreed time, Camper Imperium may demand compensation. If the order cannot be carried out on time, a flat rate of CHF 1000 can be claimed for each day on which we cannot bring another order forward.

Claims or rights of the customer against Camper Imperium may not be assigned or pledged without the customer's consent, unless the customer has demonstrated a legitimate interest in the assignment or pledge.

After completion of the project, Camper Imperium has a legitimate interest in creating reference images and publishing them on its own online presence without further consent from the customer. The reference images must fulfil the data protection requirements. No personal data is published. 5. Delivery and Performance Period

Our services are provided depending on the scope of services and within an agreed period of time. The date specified in the offer is non-binding. Binding dates will be confirmed by us separately. Deviations from the delivery period can result in particular from delays in the procurement of vehicles and built-in parts by our suppliers. If non-compliance with the provision of services is impossible or excessively difficult due to force majeure or other events for which we are not responsible (e.g. the effects of natural disasters, illness or death), the service periods are extended accordingly and we are released from our obligation to perform for the duration of the hindrance.

Camper Imperium reserves the right to withdraw from the contract if obstacles persist for the foreseeable future. The customer will be informed immediately of delays and all services received will be reimbursed. The customer cannot assert rights due to default for the aforementioned reasons.

The customer is fully responsible for a delay in delivery due to the fault of the customer or a third party commissioned by him.

The transfer of risk takes place when the vehicle or project result is handed over. If the customer is in default of delivery for reasons for which he is responsible or if he wishes the handover to take place later, the risk passes to him from the beginning of the delay.

 

6. Right of Withdrawal and Withdrawal

The customer has the right to terminate the contract at any time. He is then still obliged to pay the agreed remuneration minus our saved expenses. In addition, the contract can be terminated by either party for important reasons. In this case, the remuneration that has accrued up to that point for the work we have performed is due.

8. Notification of Defects and Warranty

The customer and Camper Imperium agree on the materials of a service and production, especially if they involve the processing of natural materials, such as wood. The Camper Imperium expressly points out that real wood is not considered to be the usual material for vehicle construction, but can be used if the care instructions handed out or communicated are observed. When using real wood, deformation or color changes of the wood can occur again and again. This is not a quality defect that a warranty claim requires. The customer undertakes to report such anomalies to Camper Imperium immediately so that appropriate measures can be taken.

Claims for defects are to be reported to Camper Imperium at the latest within 7 days after the handover of the vehicle. Camper Imperium provides a warranty for defects by repairing or remanufacturing at its own discretion. If the rectification fails, the customer can demand a price reduction or cancellation of the contract. This also applies if we seriously and finally refuse to rectify the defect. The customer does not have the right to withdraw if the defect or a breach of duty is insignificant.

In the case of items procured from other manufacturers for the agreed project (e.g. refrigerator), a warranty claim against Camper Imperium is excluded. However, the manufacturer's warranty information shall apply, provided that it is valid in Switzerland. In all other respects, the Swiss statutory warranty provisions pursuant to Art. 197 ff. OR apply, unless these are contractually excluded.
